Please read these Terms carefully before using the Platform. They define the nature of Reliant Driving Instructors's role as an introduction intermediary only, and set out the complete exclusion of our liability in respect of any driving lesson or instructor-learner arrangement. Important notice: The Platform known as "Reliant Driving Instructors" is owned and operated by Colin Fairnie trading as Reliant Technologies, 25 Delta Drive, Musselburgh, East Lothian, EH21 8HY. It is an online introduction service only — not a driving school, employer, or party to any lesson. All driving lessons are contracted directly and exclusively between the learner and the individual instructor. Colin Fairnie trading as Reliant Technologies accepts no liability of any kind in connection with any lesson or instructor-learner arrangement.

1. Introduction, Identity of the Operator & Nature of the Platform

These Terms and Conditions ("Terms") govern your use of the website www.reliantdrivinginstructors.co.uk, the Reliant Driving Instructors platform, and all associated services (collectively, the "Platform").

OPERATOR IDENTITY: The Platform is owned and operated exclusively by Colin Fairnie trading as Reliant Technologies ("we", "us", "our", "the Operator"). The trading name "Reliant Driving Instructors" refers solely to the name of this Platform and does not denote a separate legal entity, a driving school, a driving instruction business, or any organisation other than Colin Fairnie trading as Reliant Technologies.

By accessing or using the Platform in any capacity — whether as a learner driver, a driving instructor, or a visitor — you agree to be bound by these Terms in full and without reservation. If you do not agree to these Terms, you must immediately cease using the Platform.

CRITICAL NOTICE — PLEASE READ CAREFULLY:

The Platform operated by Colin Fairnie trading as Reliant Technologies functions exclusively and solely as an online introduction intermediary. Its one and only function is to introduce learner drivers ("learners" or "students") to self-employed, independent DVSA-approved driving instructors ("instructors") who have chosen to list their services on the Platform.

Colin Fairnie trading as Reliant Technologies, and the Platform known as Reliant Driving Instructors, is NOT and shall never be construed as: — A driving school of any kind — A provider of driving tuition, instruction, or any related service — An employer, principal, franchisor, or agent of any instructor — A party to any lesson, course, agreement, or arrangement between a learner and an instructor — Responsible in any way for the acts, omissions, conduct, competence, or safety record of any instructor — Responsible in any way for the conduct, fitness to drive, medical fitness, or actions of any learner — Responsible for any road traffic incident, accident, injury, or loss of any kind occurring in connection with any driving lesson

All driving lessons, courses, and arrangements are contracted directly, exclusively, and solely between the individual learner and the individual instructor. Colin Fairnie trading as Reliant Technologies has no involvement in, control over, or responsibility for those arrangements whatsoever.

By using this Platform, you unconditionally and irrevocably acknowledge and accept the nature of the Platform as a pure introduction intermediary only, and the complete exclusion of liability set out in these Terms.

2. The Instructor Listing Model — Independent Contractors

Every instructor listed on the Platform is a self-employed, independent professional holding a current DVSA Approved Driving Instructor (ADI) badge. Listing on the Platform is free of charge.

Instructors are not, and shall not be deemed to be, employees, workers, agents, sub-contractors, or representatives of Colin Fairnie trading as Reliant Technologies in any capacity whatsoever. No employment relationship, agency relationship, partnership, joint venture, or any other business relationship of any kind exists or is implied between Colin Fairnie trading as Reliant Technologies and any instructor.

Each instructor operates entirely independently under their own professional responsibility and entirely at their own risk. Instructors alone determine and are solely responsible for: — Their own lesson prices, payment terms, and fee structures — Their own availability, scheduling, and cancellation policies — Their own teaching methods, lesson content, and professional approach — Their own vehicle(s), equipment, and roadworthiness thereof — Their own professional indemnity, motor insurance, and public liability insurance — Their own compliance with all applicable laws, DVSA regulations, and professional standards — Their own conduct, behaviour, and professional standards at all times

Colin Fairnie trading as Reliant Technologies exercises absolutely no control, direction, supervision, or oversight over any instructor's professional activities, conduct, business operations, or personal behaviour at any time.

Colin Fairnie trading as Reliant Technologies makes no representation, warranty, or guarantee of any kind — express or implied — regarding the quality, safety, suitability, competence, reliability, honesty, or conduct of any instructor listed on the Platform. The inclusion of an instructor on the Platform does not constitute an endorsement, recommendation, vetting, approval, or verification of that individual by Colin Fairnie trading as Reliant Technologies.

Learners engage with instructors entirely at their own risk. Colin Fairnie trading as Reliant Technologies accepts no responsibility or liability of any kind arising from that engagement.

3. The Introduction Service — How It Works

When a learner submits a search or lesson request through the Platform, that action constitutes an expression of interest in being introduced to a local instructor. It does not constitute a booking, a contract, a reservation, or a commitment of any kind.

Upon a learner selecting an instructor and confirming their request, a one-off introduction fee of £19.95 (twenty-nine pounds and ninety-five pence) is charged to the learner. This fee is payable to Colin Fairnie trading as Reliant Technologies and covers the introduction service only — that is, the act of connecting the learner with the instructor and sharing contact details between the two parties. It does not constitute payment for any driving lesson, course, or instruction of any kind.

Following payment of the introduction fee and the exchange of contact details: — The learner and instructor are connected directly — All further communication, negotiation, and arrangement takes place exclusively between the learner and the instructor — Colin Fairnie trading as Reliant Technologies is not a party to any subsequent arrangement and accepts no responsibility or liability of any kind arising from it — Lesson scheduling, pricing, payment, content, cancellation terms, and all other matters are agreed solely between the learner and the instructor

Colin Fairnie trading as Reliant Technologies does not guarantee that a suitable instructor will be available in any given area or postcode. Where no instructor is currently available, a learner's enquiry may remain unmatched until suitable coverage becomes available. An unmatched enquiry creates no obligation on Colin Fairnie trading as Reliant Technologies to provide an introduction within any particular timeframe, or at all.

The introduction service is complete upon the exchange of contact details. Colin Fairnie trading as Reliant Technologies has no further role, obligation, or liability following that exchange.

3A. Instructor Obligation to Contact Students

Upon receiving a student's contact details following a completed introduction, the instructor is under an immediate and binding obligation to contact that student without undue delay to arrange their first driving lesson.

Students pay the £19.95 introduction fee in reasonable expectation of being contacted by their chosen instructor. Instructors who fail to make prompt, genuine contact with students following an introduction are in breach of their obligations under these Terms.

For the avoidance of doubt: — Instructors must make contact with the student as soon as reasonably practicable following receipt of the student's details — and in any event within 24 hours of receiving them — Contact must be a genuine, good-faith attempt to arrange lessons — not a cursory or token message — Instructors must not ignore, delay, or avoid contact without reasonable justification — Where an instructor is temporarily unavailable (for example, due to illness or holiday), they must notify Colin Fairnie trading as Reliant Technologies promptly and must not accept new introductions during that period

Failure to contact a student following a completed introduction may result in: — Immediate suspension of the instructor's profile from the Platform — Permanent removal from the Platform at Colin Fairnie trading as Reliant Technologies's absolute discretion — The instructor being held personally liable for the student's financial loss (the £19.95 introduction fee) where that loss is directly attributable to the instructor's failure to make contact

Colin Fairnie trading as Reliant Technologies reserves the right to investigate any complaint from a student that an instructor has failed to make contact, and to take such action as it considers appropriate, including suspension or removal of the instructor's profile without prior notice. Any such action is taken solely in respect of the instructor's listing on the Platform and does not constitute any acceptance of liability by Colin Fairnie trading as Reliant Technologies in respect of the lesson relationship.

4. Payments & Fees

Learners are charged a one-off introduction fee of £19.95 upon being matched with and connected to an instructor. This fee is payable to Colin Fairnie trading as Reliant Technologies and is processed securely via our payment provider. The introduction fee covers the introduction service only and does not constitute payment for any driving lesson, course, or instruction of any kind.

Colin Fairnie trading as Reliant Technologies is not responsible for any failure, error, or interruption in the payment processing service provided by any third-party payment processor. Any payment disputes relating to the introduction fee must be raised with Colin Fairnie trading as Reliant Technologies directly at [email protected].

All lesson fees are payable directly to the instructor. Colin Fairnie trading as Reliant Technologies is not a party to any payment transaction between a learner and an instructor in respect of lessons. Instructors are solely responsible for setting, communicating, collecting, and accounting for their own lesson fees. Colin Fairnie trading as Reliant Technologies accepts no liability whatsoever for any pricing error, overcharge, undercharge, failed payment, disputed transaction, or financial loss of any kind arising between a learner and an instructor.

Listing on the Platform is currently free for instructors. Colin Fairnie trading as Reliant Technologies reserves the right to introduce fees for instructor listings at any time upon reasonable prior notice.

5. Cancellations & Refunds

The £19.95 introduction fee is non-refundable once the introduction has been completed — that is, once the learner's and instructor's contact details have been exchanged. At that point, the introduction service has been fully delivered and the fee is earned by Colin Fairnie trading as Reliant Technologies.

Colin Fairnie trading as Reliant Technologies may, entirely at its own absolute discretion, consider refund requests in exceptional circumstances (for example, where a technical error prevented the introduction from completing). Any such consideration shall not be construed as an obligation, a policy, or a precedent. Colin Fairnie trading as Reliant Technologies's decision on any refund request shall be final.

Cancellation and refund terms for driving lessons are a matter exclusively and solely between the learner and the instructor. Each instructor operates their own cancellation policy, which is their sole responsibility to communicate clearly to learners before commencing lessons. Colin Fairnie trading as Reliant Technologies has no involvement in, and accepts no liability for, any lesson cancellation, rescheduling, or refund dispute between a learner and an instructor.

Colin Fairnie trading as Reliant Technologies accepts no liability whatsoever for any loss, cost, inconvenience, wasted expenditure, or damage of any kind arising from a cancellation, rescheduling, non-attendance, or failure to deliver lessons by either a learner or an instructor.

6. Learner Responsibilities & Warranties

By using this Platform and requesting an introduction to an instructor, you as a learner warrant, represent, and confirm that:

— You hold a valid provisional driving licence issued by the DVLA and are legally entitled to receive driving instruction in the United Kingdom at the time of your request — You will disclose, prior to your first lesson, any medical conditions, disabilities, eyesight issues, or other factors that may affect your ability to drive safely, directly to your instructor — this is your legal and personal responsibility, not that of Colin Fairnie trading as Reliant Technologies — You will attend all arranged lessons punctually and in a fit and sober state to receive instruction — You will not attend any lesson under the influence of alcohol, illegal drugs, or any prescription or over-the-counter medication that may impair your ability to drive safely — All personal information provided during registration and when requesting an introduction is accurate, complete, current, and truthful — You are aged 17 or over (or 16 if you receive the higher rate of the mobility component of Disability Living Allowance) — You understand and accept that the Platform is an introduction service only, operated by Colin Fairnie trading as Reliant Technologies, and that all responsibility for the lesson relationship lies solely with you and your instructor

Colin Fairnie trading as Reliant Technologies accepts absolutely no liability for any consequence, loss, injury, damage, or claim of any kind arising from a learner's failure to comply with the above warranties or from any aspect of the lesson relationship. All such matters are solely and exclusively between the learner and the instructor.

7. Instructor Responsibilities, Warranties & Independent Status

By registering as an instructor on the Platform, you as an instructor warrant, represent, and confirm that you:

— Hold a current, valid ADI (Approved Driving Instructor) badge issued by the DVSA and will maintain it in good standing throughout the entire period of your listing on the Platform — Hold fully adequate motor insurance that covers learner drivers in your vehicle(s), and will maintain such insurance throughout the period of your listing — you accept that Colin Fairnie trading as Reliant Technologies does not verify, monitor, or guarantee your insurance status — Hold any other professional insurance (including public liability insurance) that is appropriate for your activities as a driving instructor — Are solely and entirely responsible for the safety, conduct, quality, delivery, and outcome of all lessons you provide — Are solely responsible for your own vehicle(s), their roadworthiness, their maintenance, and all associated legal requirements — Will comply with all applicable laws, regulations, Highway Code requirements, and DVSA standards at all times — Will not misrepresent your qualifications, experience, credentials, availability, or any other material fact to any learner — Are operating as a self-employed independent professional and expressly acknowledge that you are not an employee, worker, agent, or representative of Colin Fairnie trading as Reliant Technologies in any capacity — Will not hold Colin Fairnie trading as Reliant Technologies responsible for any aspect of your professional activities, income, business, or any claim arising from your lessons

Colin Fairnie trading as Reliant Technologies accepts absolutely no liability for any act, omission, negligence, misconduct, breach of duty, or criminal conduct by any instructor. All claims arising from a lesson, course, or any interaction between a learner and an instructor must be directed to the instructor personally. Colin Fairnie trading as Reliant Technologies shall not be joined as a party to any such claim and shall not be liable for any loss, damage, or injury arising from an instructor's professional activities.

8. Limitation & Exclusion of Liability — CRITICAL

THIS CLAUSE IS OF FUNDAMENTAL IMPORTANCE. PLEASE READ IT CAREFULLY IN FULL.

Colin Fairnie trading as Reliant Technologies operates solely as an online introduction platform. It is not a driving school, does not provide driving instruction, and has no involvement in, control over, or responsibility for any driving lesson or instructor-learner arrangement. The following exclusions of liability reflect this reality and are a fundamental condition of your use of the Platform.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, COLIN FAIRNIE TRADING AS RELIANT TECHNOLOGIES EXPRESSLY AND COMPLETELY EXCLUDES ALL LIABILITY — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY, MISREPRESENTATION, OR OTHERWISE — FOR ANY LOSS, DAMAGE, INJURY, COST, OR EXPENSE OF ANY NATURE WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH:

— Any driving lesson, course, or other arrangement between a learner and an instructor, whether or not facilitated through this Platform — Any road traffic incident, accident, collision, near-miss, or injury of any kind occurring during, before, after, or in connection with any lesson, whether or not the learner was driving at the time — The death or personal injury of any person arising from or connected with any driving lesson or instructor's conduct (save as set out in the statutory exception below) — The conduct, competence, fitness to practise, safety record, suitability, honesty, or professional standards of any instructor — Any failure by an instructor to attend, commence, deliver, complete, reschedule, or perform any lesson or course — Any failure of a learner to pass a driving test, theory test, hazard perception test, or any other assessment — Any loss of earnings, loss of employment opportunity, loss of profit, loss of contract, or any other consequential, indirect, or economic loss of any kind suffered by a learner or instructor — Any inaccuracy, incompleteness, error, or omission in any information provided by an instructor on the Platform — Any dispute, disagreement, breakdown, or legal claim between a learner and an instructor — Any technical failure, interruption, downtime, error, data loss, or unavailability of the Platform or any third-party service integrated with it (including our payment provider) — Any unauthorised access to, alteration of, or theft of your data or personal information, except where directly and solely caused by Colin Fairnie trading as Reliant Technologies's own proven gross negligence

THE PLATFORM IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND. COLIN FAIRNIE TRADING AS RELIANT TECHNOLOGIES MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE — EXPRESS OR IMPLIED — THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR FIT FOR ANY PARTICULAR PURPOSE.

COLIN FAIRNIE TRADING AS RELIANT TECHNOLOGIES'S TOTAL AGGREGATE LIABILITY TO ANY PERSON IN RESPECT OF ANY CLAIM ARISING UNDER OR IN CONNECTION WITH THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE SUM OF £19.95 (NINETEEN POUNDS AND NINETY-FIVE PENCE) — BEING THE AMOUNT OF THE INTRODUCTION FEE PAID — REGARDLESS OF THE NATURE, BASIS, OR NUMBER OF CLAIMS.

THE ENTIRE RISK ARISING FROM YOUR USE OF THE PLATFORM AND FROM ANY LESSON OR ARRANGEMENT WITH AN INSTRUCTOR RESTS SOLELY WITH YOU. COLIN FAIRNIE TRADING AS RELIANT TECHNOLOGIES IS AN INTRODUCTION INTERMEDIARY ONLY AND BEARS NO RISK WHATSOEVER IN RESPECT OF THE LESSON RELATIONSHIP.

STATUTORY EXCEPTION: Nothing in these Terms shall exclude or limit liability for death or personal injury caused directly by Colin Fairnie trading as Reliant Technologies's own proven negligence, or for fraud or fraudulent misrepresentation by Colin Fairnie trading as Reliant Technologies. All other liability is excluded to the absolute maximum extent permitted by the laws of Scotland and, where applicable, England and Wales.

9. Indemnity

You agree to fully, unconditionally, and irrevocably indemnify, defend, and hold harmless Colin Fairnie trading as Reliant Technologies from and against any and all claims, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable legal fees on a full indemnity basis) arising out of or in connection with:

— Your use of the Platform in any capacity — Any breach by you of these Terms — Any act, omission, negligence, or misconduct by you in connection with any lesson, course, or arrangement with an instructor or learner — Any false, misleading, or inaccurate information provided by you on the Platform — Any claim brought against Colin Fairnie trading as Reliant Technologies by a third party (including a learner, instructor, or any other person) as a result of your conduct, professional activities, or breach of these Terms — Any road traffic incident, accident, or injury arising from or connected with any lesson you were involved in as an instructor or learner

This indemnity applies in full to instructors in respect of any claim arising from their professional activities, conduct, vehicle, insurance, or failure to comply with their obligations under these Terms or applicable law.

10. Disputes Between Learners & Instructors

Any dispute, complaint, claim, or legal proceeding arising from a driving lesson or course — including but not limited to quality of instruction, professional conduct, cancellations, refunds, safety incidents, road traffic accidents, personal injury, or any other matter — is a matter solely, exclusively, and entirely between the learner and the instructor concerned.

Colin Fairnie trading as Reliant Technologies has no obligation whatsoever to investigate, mediate, arbitrate, adjudicate, or resolve any such dispute. Colin Fairnie trading as Reliant Technologies will not act as an intermediary, witness, or party in any dispute between a learner and an instructor. Any voluntary assistance Colin Fairnie trading as Reliant Technologies may choose to provide in exceptional circumstances shall not be construed as acceptance of liability, obligation, or responsibility.

Learners and instructors expressly agree that Colin Fairnie trading as Reliant Technologies shall not be named as a defendant, respondent, or party in any legal proceedings arising from the lesson relationship, and agree to indemnify Colin Fairnie trading as Reliant Technologies against any costs incurred in defending any such proceedings.

Colin Fairnie trading as Reliant Technologies reserves the right, at its sole discretion and without liability, to suspend or permanently remove any instructor from the Platform where it receives credible evidence of serious misconduct, criminal conduct, lapse of ADI status, lapse of insurance, or a material breach of these Terms.

11. Intellectual Property Rights

11.1 OWNERSHIP

All intellectual property rights in and to the Platform and its entire contents are owned exclusively by Colin Fairnie trading as Reliant Technologies or are licensed to Colin Fairnie trading as Reliant Technologies. This includes, without limitation:

— The trading names "Reliant Driving Instructors" and "Reliant Technologies" and all associated goodwill — All logos, brand marks, icons, colour schemes, and visual identity elements — The Platform's design, layout, look and feel, user interface, and user experience — All text, copy, written content, descriptions, and marketing materials published on the Platform — All software, source code, object code, algorithms, databases, and technical architecture underlying the Platform — All graphics, illustrations, photographs, and multimedia content created for or published on the Platform — All domain names, including www.reliantdrivinginstructors.co.uk and any associated subdomains — All data compilations, instructor listings, search functionality, and matching algorithms — All business processes, methodologies, and systems developed for the operation of the Platform

These rights are protected under the Copyright, Designs and Patents Act 1988, the Trade Marks Act 1994, the Database Regulations 1997 (SI 1997/3032), the Computer Misuse Act 1990, and all applicable intellectual property laws of Scotland, England and Wales, and international conventions including the Berne Convention and the TRIPS Agreement.

11.2 TRADE MARKS AND TRADING NAMES

"Reliant Driving Instructors" and "Reliant Technologies" are the trading names of Colin Fairnie. These names, together with any associated logos and brand elements, may not be used by any person or entity — in any context, medium, or jurisdiction — without the express prior written consent of Colin Fairnie trading as Reliant Technologies.

In particular, no person may: — Register or attempt to register any trade mark, company name, domain name, or social media handle that is identical or confusingly similar to "Reliant Driving Instructors", "Reliant Technologies", or any variation thereof — Use these names in any way that implies association, endorsement, or affiliation with Colin Fairnie trading as Reliant Technologies — Use these names in any advertising, marketing, or promotional material without express written permission

11.3 COPYRIGHT NOTICE

© Colin Fairnie trading as Reliant Technologies. All rights reserved. All content on this Platform is protected by copyright. The copyright year of first publication is 2024. Unauthorised reproduction of any content, in whole or in part, is strictly prohibited.

11.4 DATABASE RIGHTS

The compilation of instructor listings, learner data, postcode data, search results, and all other structured data on the Platform constitutes a database protected under the Copyright and Rights in Databases Regulations 1997. Colin Fairnie trading as Reliant Technologies is the database maker and holds all database rights. No person may extract or re-utilise a substantial part of the contents of any database on the Platform without express written consent.

11.5 PERMITTED USE

Users are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purpose — that is, for learners to find and be introduced to driving instructors, and for instructors to list their services. This licence does not permit any other use.

11.6 PROHIBITED ACTS

The following acts are strictly prohibited and may constitute both a civil wrong giving rise to a claim for damages and a criminal offence:

— Copying, reproducing, republishing, uploading, posting, transmitting, or distributing any part of the Platform's content in any medium without express written consent — Scraping, crawling, spidering, or otherwise extracting data from the Platform by automated or manual means, including but not limited to instructor listings, contact details, postcode data, or pricing information — Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying structure of the Platform — Creating any competing platform, directory, or service that replicates, imitates, or is substantially similar to the Platform's design, functionality, or business model using information or materials obtained from the Platform — Framing, mirroring, or embedding any part of the Platform on any other website or application without express written consent — Removing, obscuring, or altering any copyright notice, trade mark notice, or other proprietary rights notice on the Platform — Using any content from the Platform to train, develop, or improve any artificial intelligence, machine learning, or automated system without express written consent — Passing off any goods or services as those of Colin Fairnie trading as Reliant Technologies

11.7 USER-SUBMITTED CONTENT

Where users (including instructors) submit content to the Platform — including profile information, photographs, descriptions, or any other material — the user warrants that they own all intellectual property rights in that content or have obtained all necessary licences and permissions to submit it. By submitting content, the user grants Colin Fairnie trading as Reliant Technologies a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, display, and distribute that content for the purposes of operating the Platform. The user indemnifies Colin Fairnie trading as Reliant Technologies against any claim arising from any third-party intellectual property rights in user-submitted content.

11.8 ENFORCEMENT

Colin Fairnie trading as Reliant Technologies will actively enforce its intellectual property rights to the fullest extent of the law. In the event of any infringement, Colin Fairnie trading as Reliant Technologies reserves the right to:

— Seek an immediate injunction (including an emergency interim injunction without notice) to prevent further infringement — Claim damages, including additional damages under section 97(2) of the Copyright, Designs and Patents Act 1988 where infringement is flagrant — Seek an account of profits made by the infringer — Seek delivery up and destruction of infringing materials — Report criminal conduct to the relevant authorities, including under the Computer Misuse Act 1990 where applicable — Pursue all available remedies in any jurisdiction where infringement occurs

The costs of any enforcement action, including legal fees on a full indemnity basis, will be sought from the infringer.

12. Privacy, Data Protection & GDPR

Colin Fairnie trading as Reliant Technologies collects and processes personal data (including name, contact details, postcode, provisional licence information, and usage data) as a data controller under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, solely for the purpose of operating the Platform and facilitating introductions between learners and instructors.

By registering on the Platform, you explicitly consent to Colin Fairnie trading as Reliant Technologies sharing your relevant contact details (name, email address, phone number, and postcode) with the instructor you have been matched with, for the sole and limited purpose of facilitating the introduction and any subsequent lesson arrangement. This data sharing is a necessary and integral part of the introduction service.

Colin Fairnie trading as Reliant Technologies will not sell, rent, or otherwise transfer your personal data to third parties for marketing or commercial purposes.

13. Termination & Suspension

Colin Fairnie trading as Reliant Technologies reserves the right to suspend, restrict, or permanently terminate any user's access to the Platform at any time, with or without notice and without liability, for any reason including but not limited to:

— Breach of any provision of these Terms — Provision of false, misleading, or fraudulent information — Conduct that Colin Fairnie trading as Reliant Technologies reasonably considers harmful, abusive, threatening, or damaging to the Platform, its users, or its reputation — Lapse, suspension, revocation, or non-renewal of ADI status (instructors) — Lapse or inadequacy of motor insurance (instructors) — Any criminal conviction or caution relevant to the provision of driving instruction — Any other reason at Colin Fairnie trading as Reliant Technologies's absolute discretion

Upon termination, all rights granted to the user under these Terms cease immediately. Termination does not affect any accrued rights or liabilities of either party, nor does it affect any provision of these Terms that is expressly or by implication intended to survive termination.

14. Changes to These Terms

Colin Fairnie trading as Reliant Technologies reserves the right to amend, update, or replace these Terms at any time without prior notice. The current version will always be published on this page with the date of last update. Your continued use of the Platform following any amendment constitutes your unconditional acceptance of the updated Terms.

It is your sole responsibility to review these Terms periodically. Colin Fairnie trading as Reliant Technologies accepts no liability for any loss, damage, or inconvenience arising from your failure to review updated Terms.

15. Governing Law, Jurisdiction & Severability

These Terms and Conditions are governed by and construed in accordance with the laws of Scotland. Any dispute, claim, or matter arising under or in connection with these Terms or the Platform — whether contractual, tortious, statutory, or otherwise — shall be subject to the jurisdiction of the Scottish courts, to which both parties submit. Nothing in this clause prevents Colin Fairnie trading as Reliant Technologies from seeking injunctive or other equitable relief in any jurisdiction.

Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, void, or unenforceable in whole or in part, that provision shall be deemed severed from these Terms and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between Colin Fairnie trading as Reliant Technologies and the user in relation to the subject matter hereof and supersede all prior agreements, representations, and understandings.

Waiver: The failure of Colin Fairnie trading as Reliant Technologies to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or any other provision.

No Third-Party Rights: These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999.
